  1. ELIGIBILITY: The Halo Top Fruit Pops For a Year Sweepstakes (the “Sweepstakes”) is open to legal residents of the United States, who are 18 years or older or the age of majority in their state of residence at the time of entry, and who follow @HaloTopCreamery on Instagram. Employees of Wells Enterprises, Inc. and any of its related companies, parents, subsidiaries, affiliates and agents and any agencies or other companies involved in the development or execution of the Sweepstakes or production or distribution of Sweepstakes materials, as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. Void where prohibited.
  2. AGREEMENT ON OFFICIAL RULES: By participating in the Sweepstakes, participants agree to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Sweepstakes. Whether a participant receives a prize is contingent upon fulfilling all requirements set forth herein and complying with Sponsor’s requests during the verification process.
  3. PROMOTION PERIOD: The Sweepstakes begins on [5/26 at 11 a.m. CT] and ends on [6/1 at 11:59 p.m. CT] (the "Sweepstakes Period"). Sponsor’s computer is the official time keeping device for this Sweepstakes.
  4. HOW TO ENTER: During the Sweepstakes Period, participants will receive one (1) entry by following @HaloTopCreamery and commenting on the Sweepstakes post with their favorite on-the-go summer activity. Limit one (1) entry per person, regardless of the number of Instagram accounts. Use of fraudulent methods to enter this Sweepstakes or circumvent the rules, may result in disqualification of all entries received at the sole discretion of the Sponsor. Any submissions that display inappropriate, graphic or lewd content will be ineligible. Any submission that, in Sponsor’s sole and absolute discretion, violates the above criteria will be disqualified. In the event of a dispute regarding an entry, the entry will be deemed to have been submitted by the Authorized Account Holder of the Instagram account utilized at the time of entry, provided that person meets all eligibility requirements set forth in these Official Rules. “Authorized Account Holder” means the natural person who is assigned to the Instagram Account. Proof of submission will not be deemed to be proof of receipt by Sponsor.
  5. WINNER SELECTION: Sponsor will randomly select one potential winner from among all eligible entries received during the Sweepstakes Period, provided a sufficient number of eligible entries are received. Potential Winner will be notified by Instagram direct message on (6/4). Any Potential Winner must respond to the winner notification message within 48 hours of transmission. If the potential winner does not respond to the message within 48 hours, then the potential winner will forfeit the prize and alternate winner will be selected according to the selection method from remaining eligible entries.
  6. PRIZE AND ODDS OF WINNING: One (1) Grand Prize: one (1) Year Supply of Fruit Pops via 104 printed coupons (6 ct pop cartons only) (ARV: $261). Odds of winning depend upon the total number of eligible entries received. Sponsor reserves the right to substitute the prize or any portion of the prize with a prize of equal or greater value. All prizes will be awarded, provided they are properly claimed.
  7. WINNER REQUIREMENTS: Winner is subject to verification before any prize will be awarded. Any and all prize-related expenses, including without limitation any and all federal, state and/or local taxes, shall be the sole responsibility of Winner. All federal, state, and local laws and regulations apply. Potential Winner may be required to complete, sign, and return an Affidavit of Eligibility, and where permitted, a Release of Liability and/or Publicity within fourteen (14) days of first attempted notification by Sponsor. If a Potential Winner does not return the documents in the time frame specified, or prize is returned as undeliverable, Potential Winner forfeits the prize and an alternate Winner will be selected.
  8. RELEASE: By accepting the prize, Winner agrees to release and hold Sponsor and its directors, officers, employees, and assigns, harmless against any and all claims and liability arising out of acceptance, use and/or misuse of prize. Winner assume all liability for any injury or damage caused, or claimed to be caused by participation in this Sweepstakes or acceptance, use and/or misuse of any prize awarded herein. Any violation of these Official Rules may result in disqualification. Sponsor is not responsible for any typographical or other error in the printing, the offering, or the announcement of any prize or in the administration of the Sweepstakes. By entering this Sweepstakes, participants grant Sponsor the unrestricted, absolute, perpetual, world-wide, non-exclusive right and license (except where prohibited by law) to publish, reproduce, distribute, display and transmit the Entry details throughout the world in any manner, form or format now or hereinafter created and for any purpose without further payment consent. All Entries become the property of Sponsor.
  9. GENERAL CONDITIONS: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
  10. DISPUTES: Except where prohibited, you agree that any and all disputes, claims, and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Iowa. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of Iowa, without giving effect to any choice of law or conflict of law rules (whether of Iowa or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Iowa.
  11. WINNER LIST: For the name of the Winner, send an email to Halo Top at [email protected]. Requests must be received within four (4) weeks of the end of the Sweepstakes Period.
